📌 સરળ સાર

Rule 10(4) હેઠળ જાહેર હિતમાં લાગુ પડતા કેસ મુજબ 50 અથવા 55 વર્ષની ઉંમરે Government servantની service review કરી premature retirementનો નિર્ણય થઈ શકે છે. 29-09-2023નો આ GR અગાઉની instructionsને consolidate કરે છે અને Appendix-Aમાં review, committee, criteria, procedure, representation અને record requirements આપે છે.

02. Review Committeeના Broad Criteria

Doubtful Integrity:- Integrity doubtful હોય તો retirement માટે consider.

Ineffectiveness:- Fitness/competenceના આધારે review.

Entire Service Record:- સંપૂર્ણ relevant record જોવાનો.

મહત્વપૂર્ણ: Ineffectivenessના ground પર સામાન્ય રીતે એક વર્ષની અંદર superannuation થનાર કર્મચારીને retire ન કરવો; sudden and steep fall હોય તો review શક્ય. Doubtful integrity માટે આ restriction નથી.

03. તાજેતરની Promotion

Preceding 5 yearsમાં higher post પર promotion અને highest postમાં satisfactory service હોય તો ineffectivenessના ground પર સામાન્ય રીતે premature retirement ન કરવી. Doubtful integrity માટે આવી protection નથી.

04. Notice અને Representation

Immediate retirementમાં 3 months' notice ન અપાય તો 3 months' pay and allowance in lieu ચૂકવવાના. Order/noticeની service પછી સામાન્ય રીતે 3 weeksમાં representation થઈ શકે છે; authorityએ representation મળ્યા પછી 8 weeksમાં નિર્ણય લેવાનો છે.

📌 Executive Summary

Under Rule 10(4), a Government servant's service may be reviewed at age 50 or 55, as applicable, for premature retirement in public interest. This GR consolidates earlier instructions and Appendix-A sets out review, committee, criteria, procedure, representation and record requirements.

02. Broad Criteria

Doubtful Integrity:- Consideration where integrity is doubtful.

Ineffectiveness:- Review based on fitness/competence.

Entire Service Record:- Entire relevant service record is considered.

Important: Ordinarily, retirement for ineffectiveness should not be used where superannuation is within one year, except a sudden and steep fall. This restriction does not apply to doubtful integrity.

03. Recent Promotion

If promoted to a higher post in the preceding five years and service in the highest post is satisfactory, premature retirement for ineffectiveness is ordinarily not warranted. No such protection applies to doubtful integrity.

04. Notice & Representation

If immediate retirement is ordered without three months' notice, three months' pay and allowance is payable in lieu. Representation may ordinarily be made within three weeks of service of the order/notice, and the authority should decide it within eight weeks of receipt.
