📌 સરળ સાર
આ ઠરાવ એવા ચોક્કસ કેસોમાં અધિકારી/કર્મચારીઓને જૂની પેન્શન યોજના (OPS)નો લાભ આપવા માટે છે, જ્યાં ભરતી/પસંદગી અથવા fixed-pay appointment સંબંધિત મહત્વપૂર્ણ પ્રક્રિયા 01-04-2005 પહેલાં થઈ હતી, પરંતુ regular appointment વહીવટી કારણો, કોર્ટ કેસ અથવા fixed-pay સમયગાળાને કારણે ત્યારબાદ થઈ હતી. લાભ blanket રીતે દરેક pre/post-2005 કર્મચારીને મળતો નથી; ઠરાવમાં દર્શાવેલા કેસોમાં પાત્રતા ચકાસવાની રહે છે.
ઠરાવમાં Gujarat Civil Services (Pension) Rules, 2002, 18-03-2005ના NPS સંબંધિત ઠરાવ, pension-rule clarifications અને 15-03-2024ના New Contributory Pension Scheme Rules, 2024નો સંદર્ભ આપવામાં આવ્યો છે. રાજ્ય સરકાર સમક્ષ 01-04-2005 પહેલાં શરૂ/પૂર્ણ થયેલી ભરતી પ્રક્રિયા છતાં ત્યારબાદ regular appointment મેળવનાર કેટલાક કર્મચારીઓને OPSનો લાભ આપવાનો પ્રશ્ન વિચારાધીન હતો.
ઠરાવનો મુખ્ય focus 01-04-2005 cut-off છે. Competitive recruitment/selectionના મહત્વપૂર્ણ તબક્કા, appointment order અથવા fixed-pay appointment આ તારીખ પહેલાંના હોય અને regular appointment પછી થવા પાછળ ઠરાવમાં માન્ય પરિસ્થિતિ હોય, તો સંબંધિત કેસ OPS benefit માટે વિચારવામાં આવે છે.

ઠરાવમાં આવરી લેવાયેલા મુખ્ય કેસ
CASE Aમાન્ય ભરતી બોર્ડની competitive selection process / સંબંધિત approved selection process 01-04-2005 પહેલાં પૂર્ણ થઈ હોય અને appointment order પણ cut-off પહેલાંનો હોય, પરંતુ administrative કારણસર regular appointment પછી થઈ હોય.
CASE Bભરતી પ્રક્રિયાનું result 01-04-2005 પહેલાં જાહેર થયું હોય, પરંતુ administrative reason અથવા court caseના કારણે appointment order પછી આપવામાં આવ્યો હોય અને ત્યારબાદ regular appointment મળી હોય.
CASE C01-04-2005 પહેલાં fixed-pay post પર appointment થયેલ હોય અને 01-04-2005 પછી prescribed fixed-pay period સંતોષકારક રીતે પૂર્ણ કર્યા બાદ regular appointment મળેલ હોય.

Fixed Pay કર્મચારીઓ માટે ખાસ જોગવાઈ
Page 2માં 01-04-2005 પહેલાં fixed-pay appointment ધરાવતા અને પછી fixed-payનો નિર્ધારિત સમયગાળો સંતોષકારક રીતે પૂર્ણ કરીને regular appointment મેળવનારા કર્મચારીઓનો અલગથી સમાવેશ કરવામાં આવ્યો છે. ઠરાવમાં ઉપરોક્ત fixed-pay categoryમાંથી પછી સીધી ભરતીથી અન્ય સંવર્ગમાં regular appointment મેળવનાર ચોક્કસ કેસો અંગે પણ જોગવાઈ છે; આવા individual casesમાં service continuity અને applicable conditions મૂળ ઠરાવ પ્રમાણે તપાસવા જરૂરી છે.
માત્ર એટલા માટે કે recruitment process અથવા serviceનો કોઈ ભાગ 2005 પહેલાંનો છે, OPS automatic લાગુ પડે એવું ઠરાવ કહેતો નથી. Caseને ઠરાવમાં દર્શાવેલી recruitment/result/appointment/fixed-pay conditions અને cut-off date સાથે match કરવો જરૂરી છે.

Court caseને કારણે appointment મોડું થયું હોય તો?

It also addresses specified cases where employees from that category subsequently obtained regular appointment in another cadre through direct recruitment; service continuity and the stated conditions must be checked from the original resolution in each individual case.

Who Does Not Automatically Qualify?
