Rule 66 — નિવૃત્તિ સમયે Leave Encashment રોકવા અંગેની જોગવાઈ

સામાન્ય રીતે નિવૃત્તિ સમયે પાત્ર કર્મચારીને Leave Encashment ચૂકવવામાં આવે છે.
પરંતુ જો superannuation પર નિવૃત્ત થતો સરકારી કર્મચારી suspension હેઠળ હોય અથવા તેની સામે disciplinary કે criminal proceedings pending હોય અને competent authorityને એવું લાગે કે proceedings પૂર્ણ થયા પછી કર્મચારી પાસેથી Governmentની કોઈ રકમ recover કરવાની શક્યતા છે, તો Leave Encashmentનો સંપૂર્ણ અથવા અમુક ભાગ રોકી શકાય છે.

કઈ સ્થિતિમાં જોગવાઈ લાગુ પડી શકે?
માત્ર Inquiry Pending હોય એટલે Leave Encashment રોકી શકાય?
માત્ર proceedings pending હોવાનો ઉલ્લેખ પૂરતો નથી.
Competent Authorityનો એવો અભિપ્રાય હોવો જરૂરી છે કે proceedings પૂર્ણ થયા પછી કર્મચારી પાસેથી કેટલીક Government money recover થવાની શક્યતા છે.

Suspensionમાં નિવૃત્ત થતા કર્મચારીનું Leave Encashment રોકી શકાય?
Notificationમાં દર્શાવેલી શરતો પૂરી થતી હોય અને competent authorityને proceedings પછી Government money recover થવાની શક્યતા લાગે તો whole અથવા part Leave Encashment રોકવાની જોગવાઈ છે.
Departmental Inquiry pending હોય તો આખું Leave Encashment ફરજિયાત રોકવું પડે?
Notification automatic full withholdingની જોગવાઈ કરતું નથી. Competent Authority relevant facts અનુસાર whole અથવા part encashment withhold કરી શકે છે.
Criminal case pending હોય તો Rule લાગુ પડી શકે?
હા, Notificationમાં pending criminal proceedingsનો સ્પષ્ટ ઉલ્લેખ છે, પરંતુ સાથે recoveryની શક્યતા અંગે competent authorityનો અભિપ્રાય પણ મહત્વપૂર્ણ છે.

Rule 66 — Withholding of Leave Encashment in Certain Retirement Cases
Gujarat Civil Services (Leave) Rules, 2002
The 2008 amendment adds a proviso to Rule 66 of the Gujarat Civil Services (Leave) Rules, 2002.
Where a Government servant retires on attaining the age of superannuation while under suspension or while disciplinary or criminal proceedings are pending, the competent authority may withhold whole or part of the leave encashment if it considers that some money may become recoverable from the employee on conclusion of those proceedings.

Can leave encashment be withheld when an employee retires under suspension?
The proviso permits the competent authority to withhold whole or part of the leave encashment where the specified conditions, including the possibility of Government recovery, are satisfied.
Does every pending departmental inquiry require full withholding?
The notification does not prescribe automatic full withholding in every such case. The competent authority acts according to the facts of the relevant case and the conditions contained in the proviso.
Are criminal proceedings covered?
Yes. The notification expressly refers to disciplinary or criminal proceedings pending against the Government servant.
